Introduction

These Terms and Conditions ("Terms") establish a binding legal agreement governing the services provided by BoostonServer ("we," "us," "our") to our clients ("you," "your").

By registering an account, selecting the agreement checkbox during sign-up, buying services, or accessing our platform, you acknowledge that you have read, understood, and agreed to these Terms. These provisions are structured in accordance with the prevailing laws of Bangladesh and standard global compliance policies.

To sign up and utilize BoostonServer Hosting Solutions, you must be at least 18 years old. By creating an account, you represent that you meet this age requirement and possess the legal authority to enter into this contract under Bangladeshi legislation.

If you do not consent to all conditions of these Terms, you are prohibited from using our services and must exit this platform immediately.

Governing Law & Jurisdiction

  • This agreement and all related services are governed by and construed in accordance with the laws of the People's Republic of Bangladesh.
  • Any legal disputes or actions arising from this contract shall be submitted exclusively to the jurisdiction of the competent courts in Bangladesh (primarily situated in Dhaka or Chattogram).
  • BoostonServer reserves the absolute right to cooperate fully with law enforcement and government regulators in the event of unauthorized activities or suspected criminal conduct.

Dispute Resolution

  • Before initiating any formal legal action, both parties pledge to resolve the matter amicably through direct negotiations for a minimum of 30 days starting from the date of the initial written complaint.
  • If informal talks do not yield a resolution, the parties agree to seek mediation through a mutually accepted independent mediator prior to taking court action.
  • Formal litigation or court proceedings may only be initiated if both direct consultation and mediation fail to resolve the dispute.

Account Registration & Responsibilities

  • Clients must supply authentic, current, and complete details during the registration process.
  • Maintaining the confidentiality of your login credentials and password remains your sole responsibility. BoostonServer is not responsible for any losses arising from compromised access details.
  • Profiles set up using false credentials, dummy addresses, or fraudulent telephone numbers are subject to suspension or termination without notice.
  • Creating duplicate accounts to abuse promotional offers, discounts, or trial systems is strictly prohibited.
  • If BoostonServer discovers that an account is managed or owned by an individual under the age of 18, we reserve the right to suspend it immediately.

Intellectual Property

Our Intellectual Property

The name BoostonServer, our company logo, website layouts, custom scripts, internal tools, dashboard designs, and related documentations are the exclusive intellectual property of BoostonServer and our licensors. You are prohibited from copying, distributing, adapting, or creating derivative works from these assets without our express prior written approval.

Your Hosted Content

  • You retain complete ownership rights over all text, media, files, databases, and codes uploaded to our hosting servers.
  • To facilitate normal service operations, you grant BoostonServer a non-exclusive, limited license to store, transmit, process, and display your files solely to keep your website live and operational.
  • This temporary license terminates immediately once you delete your files or close your hosting account.
  • You warrant that all hosted files do not violate any patent, trademark, copyright, or proprietary rights of third parties.

Acceptable Use Policy (AUP)

Prohibited Content

The following content categories are strictly forbidden on our servers:

  • Adult media, pornography, escort advertisements, or sexually explicit materials.
  • Child exploitation, abuse material, or any harmful content involving minors.
  • Unregulated online betting, digital gambling platforms, or lotteries lacking statutory state approval.
  • Phishing portals, fake financial institution portals, or fraudulent payment gateway mimics.
  • Warez directories, cracked scripts, nulled themes, or unauthorized digital distribution networks.
  • Hate speech, political propaganda targetting state stability, or extremist materials.
  • Illegal weapon sales, illicit drug promotions, or transactions violating the laws of Bangladesh.

Prohibited Activities

  • Unsolicited marketing broadcasts via Email, SMS, or messaging platforms like WhatsApp.
  • Hosting virus nodes, botnets, malware modules, or backdoors.
  • Executing or serving as an infrastructure point for DDoS attacks.
  • Mining cryptocurrency or hosting intensive distributed processing tasks.
  • Using web hosting plans strictly for file storage, system backups, or streaming media libraries.

Conduct & Support Channels

BoostonServer maintains a zero-tolerance policy against any harassment, abusive terminology, or threats directed at our team members. Any abusive support ticket, email, or message may result in the immediate cancellation of your service without eligibility for a refund.

Resource Usage & Fair Usage Policy

  • Shared hosting resources (such as CPU cores, RAM allocations, bandwidth, inode counts, and email quotas) are distributed among users on a server. Any account whose usage pattern degrades the stability of the platform will face immediate limits or suspension.
  • "Unlimited hosting" services are subject to fair usage. Plans are meant for standard corporate, blog, or business websites—not for hosting file download mirrors, media streaming platforms, or massive backup repositories.
  • Bulk mailing systems are not allowed on standard web hosting accounts unless prior authorization is obtained.

Payments, Billing & Refunds

Our prices are quoted in Bangladeshi Taka (BDT). For global accounts, equivalent USD pricing applies. Services must be paid for in advance to prevent service disruptions.

Invoices left unpaid for more than 7 days past the due date will trigger automated suspension, and eventually termination.

  • We accept payments via popular channels including bKash, Nagad, Rocket, bank transfers, credit/debit cards, PayPal, and Stripe.
  • Refund Policy: Shared and cloud web hosting plans come with a 30-day money-back guarantee.
  • Domains, SSL certificates, VPS plans, dedicated servers, software license fees, and SEO optimization services are non-refundable.
  • Refund requests will not be approved if the account was suspended due to violations of our Acceptable Use Policy.
  • Initiating a payment dispute or chargeback without reaching out to our billing team first will result in the immediate closure of all your services.

Pricing, Offers & Renewals Modification

Right to Modify

BoostonServer reserves the right to modify service fees, promotional offers, renewal rates, and server promises at any time to adapt to changes in global infrastructure costs, software licensing rates, or inflation.

Prior Offers & Promotional Guarantees

Any previously advertised discounts or "same price renewal" representations are subject to this modification clause. When infrastructure costs rise, renewal prices may be updated for existing subscriptions. We will make reasonable efforts to notify you via email or dashboard before applying new rates. If you do not agree with the updated rates, you may choose to cancel your subscription prior to the renewal date.

Suspension & Termination

BoostonServer reserves the right to suspend or terminate services if:

  • The customer violates any section of these terms.
  • Payments remain overdue for more than 7 days.
  • The hosting account is used for illegal, abusive, or harmful operations.
  • High resource usage threatens the stability of our servers.

Accounts that are terminated due to non-payment or policy violations will have all their files, databases, and emails permanently deleted. BoostonServer does not retain backups of terminated accounts.

Data Security & Backups

  • BoostonServer provides automated backups (daily or weekly, depending on the plan purchased), but these are provided as a courtesy. Clients must keep independent, regular backups of their data.
  • BoostonServer is not liable for data loss caused by system updates, hacker attacks, plugin failures, or hardware corruption.
  • Clients must secure their CMS software (such as WordPress, Joomla, etc.) by keeping themes and plugins updated and using strong login credentials.

Support & Communication

  • We provide technical assistance through our customer dashboard support tickets, live chat, WhatsApp, and email.
  • Our core support covers server uptime and hosting dashboard features. It does not cover website coding, database optimization, or third-party web application development.
  • Communication with our staff must remain respectful. Abuse or spamming of our support ticket channels may result in account limits.

Domain Registration & Ownership

  • Domain name registrations are governed by the regulations of ICANN and respective registry authorities.
  • Domains are registered under the name and ownership details provided by the client.
  • BoostonServer is not liable if a domain name expires because of unpaid renewal invoices.
  • Upon paying for a renewal, clients should confirm that the domain status is updated in the WHOIS directory. If any registry or API errors occur, contact us immediately.

Domain Renewal, Expiry & Liability Policy

Client Monitoring Responsibilities

  • Clients must track the expiration dates of their domains through the BoostonServer dashboard, domain registrar panels, or public WHOIS lookup tools.
  • It is the client's sole responsibility to renew domains on time to avoid redemption fees or deletion by the registry.
  • You must maintain an active, monitored contact email address in your profile to receive automated billing notifications.

Critical 30-Day Reporting Window
  • Any issues with domain renewals or registrations must be reported to our support team within 30 days of the scheduled renewal date.
  • This 30-day reporting window starts from the exact expiration date, regardless of when the client notices the issue.
  • Reports submitted after 30 days cannot be processed because of registry policies, grace period expirations, and registrar rules.
  • Failure to report within 30 days constitutes a waiver of all claims for refunds or domain recovery.

Post-30-Day Absolute Limitation

  • Complaints or recovery requests made after 30 days will be rejected.
  • After 30 days, expired domains enter the Redemption phase (subject to high recovery fees) or the Pending Delete queue, where recovery is technically impossible.
  • Registry timelines cannot be altered or bypassed by BoostonServer.

Limited Liability for Domain Loss

  • BoostonServer is not liable for direct, indirect, or consequential damages resulting from domain expiration, suspension, or deletion.
  • This includes any losses of search engine rankings, brand reputation, email access, business operations, or website traffic.
  • Clients assume all risks associated with managing domain names.

Refund Policy for Registry Failures

  • Our maximum financial liability for domain registration issues is strictly limited to a refund of the domain renewal fee paid to us.
  • Refunds are only issued if the renewal issue was caused by a system error on our infrastructure and reported to us within 30 days of the renewal date.
  • No refunds will be provided for domains that were not renewed due to client negligence, payment method issues, or unpaid invoices.

Renewal Reminders Are Courtesy Only

  • Email, SMS, or dashboard alerts sent by us are courtesy notifications. We cannot guarantee their delivery due to spam filters, network gateway failures, or incorrect contact details.
  • Failure to receive renewal alerts does not excuse the client from the responsibility of renewing their domains on time.

Irreversible Domain Loss & Public Re-Registration

  • Once a domain name is deleted by the registry, it becomes available to the public on a first-come, first-served basis.
  • If a deleted domain is registered by a third party, BoostonServer has no authority or technical ability to recover it.

Auto-Renewal & Client Due Diligence

  • We recommend enabling auto-renewal for critical domain names. Auto-renewal requires a valid payment card with sufficient funds.
  • Failed auto-renewals due to expired cards or payment gateway issues are the sole responsibility of the client.

Payment Failures & Invoice Management

  • Domain invoices are generated 30 to 45 days before expiration and must be paid before the expiry date.
  • Unpaid domain invoices will result in immediate suspension on the expiry date, followed by deletion.

Domain Lifecycle Phases

  • Grace Period (0-30 days): The domain may be renewed at standard rates, but website and email services will be suspended.
  • Redemption Period (30-60 days): The domain can only be recovered by paying registry restoration fees in addition to the standard renewal cost.
  • Pending Delete (60-75 days): The domain enters the deletion queue and cannot be recovered.

ICANN Compliance

  • Registrations and renewals must comply with ICANN guidelines and specific registry rules. Country-code domains (such as .bd) may have unique rules that override standard ICANN policies.

Domain Transfer & Lock Policies

  • Domains cannot be transferred to another registrar within 60 days of registration or renewal, in accordance with ICANN rules.
  • Domain locks must be disabled in the client portal before initiating a transfer.

Dispute Resolution & Ownership Verification

  • Domain ownership disputes must be resolved through UDRP proceedings or appropriate courts. We require identity verification documents before making changes to account ownership details.

Acknowledgment of Terms

  • By registering or renewing a domain through BoostonServer, you agree to these domain management terms.
  • You acknowledge the 30-day reporting window, the limitations of our liability, and your responsibility to monitor renewal dates.
  • These terms are binding and enforceable under Bangladeshi law and international registrar guidelines.

Service Availability (Uptime SLA)

  • BoostonServer aims for a 99.9% uptime average for shared web hosting and cloud hosting plans.
  • If server uptime drops below 99% in any calendar month, you may request SLA credits. This excludes downtime caused by scheduled maintenance, force majeure events, or client-side issues.
  • We will post notifications of scheduled server maintenance in advance.

SLA Credit Calculation

  • Downtime represents the duration in which a server is completely unreachable due to an issue under our direct control.
  • SLA credit is calculated as: (downtime minutes ÷ total minutes in the month) × monthly service fee.
  • The maximum credit is capped at 30% of the monthly fee for the affected plan.
  • SLA claims must be submitted via support ticket within 30 days of the downtime incident.
  • Credits are applied as BoostonServer account balance and cannot be withdrawn as cash.

Legal Compliance & Government Requests

Clients must comply with all laws of Bangladesh, including the ICT Act, BTRC regulations, and digital transaction rules.

BoostonServer will cooperate with law enforcement and government agencies. Hosting services may be suspended without prior notice in compliance with official court orders or regulatory requests.

Copyright & Takedown Procedure

Reporting Copyright Infringement

If you believe content hosted on our servers violates your copyright, you may submit a takedown notice to abuse@boostonserver.com. The notice must contain:

  • Identification of the copyrighted work.
  • The specific URL where the infringing content is hosted.
  • Your contact details (name, email, telephone).
  • A statement made under penalty of perjury that you are the copyright owner or authorized representative.

Our Takedown Actions

Upon receiving a valid copyright notification, BoostonServer will investigate and may temporarily disable access to the disputed files. We will notify our client of the complaint and allow them to submit a counter-notification if they believe the takedown was a mistake.

Counter-Notification

To contest a takedown, the client must send a written response to abuse@boostonserver.com stating that the content was removed due to an error, and consenting to the jurisdiction of the courts of Chattogram, Bangladesh. Repeated copyright violations will lead to permanent account termination.

Force Majeure

BoostonServer is not liable for performance delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, fiber cuts, national internet blockages, power grid failures, coordinate DDoS attacks, acts of war, or regulatory embargoes.

In the event of a force majeure situation, we will make reasonable efforts to restore standard services as quickly as possible.

Privacy & Data Handling

We process your personal details in compliance with our Privacy Policy. Information is shared with payment gateways, domain registrars, and security screening systems solely to provision services.

BoostonServer does not sell, lease, or rent customer information to third parties under any circumstances.

Limitation of Liability

To the maximum extent permitted by applicable law, BoostonServer, its employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages. This includes losses of revenue, business data, website accessibility, operational delays, or software vulnerabilities.

Our total aggregate liability for all claims arising under this agreement is strictly capped at the total fees paid by you to BoostonServer for the specific service in the 3 months preceding the event.

Indemnification

You agree to protect, defend, and hold harmless BoostonServer, our directors, employees, and suppliers from any claims, losses, legal fees, or liabilities resulting from:

  • Your use of our hosting platforms or violation of these Terms.
  • The files, web content, databases, or programs you host on our servers.
  • Any intellectual property or privacy claims raised by third parties regarding your website.
  • Any regulatory penalties or actions resulting from your hosted services.

Affiliate Program Terms

  • Self-Referrals Prohibited: Affiliates cannot earn commissions on hosting services purchased for themselves, their businesses, or their own entities.
  • Active Plan Requirement: To request withdrawals, affiliates must maintain at least one active, paid hosting service with BoostonServer.
  • Maturity Period: Referral commissions become eligible for payout 30 days after the referred client completes their payment.
  • Payout Threshold: The minimum commission withdrawal threshold is **৳5,000** (Five Thousand BDT).
  • Payment Options: Payout requests are processed through bKash, Nagad, or bank transfer within 7 business days.
  • Tax Compliance: Affiliates are responsible for any taxes associated with receiving referral commissions.
  • Referral Fraud: Spam signups, invalid referrals, or transactions that result in chargebacks will cancel the affiliate commissions.

Modifications to Terms

  • BoostonServer reserves the right to modify or replace these Terms at any time.
  • Material updates will be posted on our dashboard or sent via email at least 15 days before taking effect.
  • Your continued use of our services after updates are applied constitutes agreement to the updated Terms.
  • Non-material edits (such as formatting fixes or spelling corrections) may be made without prior announcement.

General Provisions

Entire Agreement

These Terms, along with our Privacy Policy, Refund Policy, and custom service level agreements, constitute the entire contract between you and BoostonServer, replacing all prior communications or proposals.

Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining sections will continue in full force. The invalid clause will be modified to the minimum extent necessary to make it valid.

Waiver

A failure by BoostonServer to enforce any clause of these Terms does not constitute a waiver of our rights. Any valid waiver must be made in writing by our authorized representatives.

Assignment

BoostonServer may transfer our rights and duties under this agreement in connection with a corporate merger, acquisition, or sale of assets. You may not transfer your rights under this agreement without our prior written consent.
